The decrease in prosecutions under 8 U.S. Code Section 1326, a felony for reentering the U.S. without permission after deportation, has raised eyebrows. Calvert emphasized the importance of enforcing federal laws and criticized the lack of enforcement by the court system, attributing it to President Biden's open-border policies.
The Central District of California saw a significant decline in prosecutions under 8 USC 1326(a), with only five cases in 2023 compared to 188 cases in 2018. Despite 2.5 million illegal border crossings in 2023, the number of prosecutions has drastically decreased, signaling a concerning trend in the enforcement of immigration laws.
